Welcome to The Body Shop a British cosmetics, skin care and perfume company. This website contains information about The Body Shop and the extensive range of beauty products stocked by The Body Shop. You are able to shop online or visit your nearest The Body Shop store for a variety of the products we stock

PURPOSE OF THE SITE

The purpose of the Site is to provide you with information about the business, our products and stores, the campaigns that we support and the activities we undertake.

OWNERSHIP - OPERATOR

The site (the "Site") is owned and perated by NEW CLICKS HOLDINGS LIMITED a company duly incorporated under the laws of South Africa , registered number 1996/000645/06, with its principal place of business at Corner Searle & Pontac Steets,Cape Town 8001, South Africa 1995/009967/07, (in short referred to herein as "Clicks"), under license by The Body Shop International Plc as a "The Body Shop Franchisee". Under the terms of its license Clicks also runs a cosmetics retail business in South Africa (in short "The Body Shop business"). In this document the terms in the first person, such as "we","us","our", denote the Operator, and terms in the second person, such as "you","your","yours",etc, denote you, the user/visitor of the Site.

ONLINE SHOPPING

You must be 18 years or older to place an order via this Website. You can either register and complete an online shopping profile, or shop as a guest. When checking out as a guest, you will need to provide personal details and a delivery address in order to complete the transaction. The Body Shop will not store this information, unless you explicitly request that we do so. We encourage all shoppers to register and create an online shopping profile to ensure future online shopping transactions are quick and easy.

Once you have completed an online shopping profile and have registered, you agree to keep your username and password secure and confidential. Selecting a product and adding the product to your shopping basket does not constitute a sale or order. Your order will be deemed to be confirmed once you electronically submit a completed order for one or more products offered by this Website and your payment has been authorised and you have received a tax invoice which will be sent to you via your selected communication method.

PAYMENT

Our online payment options are administered by PayU, a specialist third party payment provider who are trusted experts in the field of secure online payments. You may pay for your order by one of the following payment methods:

• Credit card: Visa or MasterCard;
• Debit card: Visa or MasterCard.

Payment will be effected on confirmation of your order and prior to delivery. The total value of your online order will debited against the payment method tendered during the checkout process.

Once you have selected your payment method and accepted these Terms, you will be directed to PayU’s secure site for payment of the applicable purchase price for the goods. Your payment will be presented to the bank for authorisation. Should such authorisation be declined, your order will be cancelled. Should the authorisation be successful, your order will be processed for delivery to you. Your payment details are held by PayU in a secure encrypted server which is not accessible from the Internet. This Website will maintain a full record of every transaction concluded via this Website for a period of 12 months from date of such sale.

CANCELLING ORDERS

Clicks reserves the right to refuse to processing of the payment for any order and/or to cancel any purchase, partially or completely, with notice given to you.

If you discover that you have made a mistake with your order and the order has not yet been confirmed by Clicks as set out in the Online Orders section above, please contact the Customer Service Centre on 0860-254-257 or [email protected] immediately. Clicks cannot guarantee that we will be able to amend or cancel your order in accordance with your instructions. Orders cannot be cancelled once they have been confirmed by Clicks as set out in the Online Orders section above. You are, however, entitled to return the products in accordance with the Returns and Defective Items sections hereunder. Delivery fees are non-refundable for cancelled orders or returned orders.

DELIVERY

Delivery is estimated to occur within 1-3 working days from the day that your order has been confirmed and it is subject to stock availability. Although Clicks will make every effort to meet the time frame for delivery, certain factors may affect delivery times and we cannot guarantee that every item will be delivered in such time frame. Deliveries will take place during office hours (8am to 5pm, Monday to Friday). No deliveries will be made on weekends and public holidays. Please note that it might not be possible for Clicks to deliver to certain areas. During the checkout process you will be required to enter your postal code and address to determine if you are eligible for door-to-door delivery. Please also note that once you have checked out, your order’s delivery method cannot be changed from door-to-door courier delivery to click & collect, and vice versa. Clicks does not deliver to PO Box addresses.

When delivery is made you will receive a delivery note displaying the following:

• Detail of items delivered

• Any items not available

• Delivery fees

• The total amount debited or paid, including VAT.

A delivery is considered complete as soon as the parcel is accepted by you or an individual on your behalf at your specified delivery address. Anyone who takes receipt of the parcel is presumed to be authorised to accept delivery on your behalf. For verification purposes, the person accepting the parcel may be required to produce some form of identification (identity document/drivers licence/passport). Should nobody be present at the address at the time of delivery, the parcel will remain with the courier company. The courier company will leave a notice at the delivery address to indicate that there was an attempted delivery. You will be contacted to arrange an alternative delivery time. Please note that we reserve the right to charge an additional delivery fee for a second attempt at delivery. Delivery will then be effected for a second time at the indicated delivery time. If at that time there is no one present at the address, the parcel will be returned to our warehouse and a return will be processed for the products purchased. The delivery fee is non-refundable. You will be contacted in order to confirm the refund method you would prefer.

It is your responsibility to ensure that you or the intended receiver of the parcel inspect(s) the parcel on arrival and makes known any complaints. The receiver has the right to refuse the parcel if it appears to have been opened or if it has been damaged.

DELIVERY FEE

Clicks charges a standard non-refundable delivery fee to deliver door-to-door and this fee will be displayed when you view your cart before checkout.

Some items (heavy or large, based on volumetric weight) may carry additional delivery fees the customer will be informed of this fee after the purchase and the order will be refunded in full if the delivery fee is not acceptable to the customer. Every reasonable effort is taken to ensure that the delivery costs displayed on the site are correct at the time of your purchase. However, if a delivery fee is incorrectly displayed, Clicks will not be obliged to deliver products at an incorrect delivery fee. Clicks will only be liable to return payment already made by you in the case you choose to cancel the sale once you have been made aware of the correct delivery fee.

RETURNS

Refunds are processed within Clicks stores, except where products are marked with a circular arrow icon on your invoice, order confirmation page or order history.

To return an order in store, simply bring the product/s in its original, unopened packaging to any The Body Shop store, along with the original invoice and delivery form, within 30 calendar days from date of purchase for an in-store refund.

To return products marked with a circular arrow icon, please contact our call centre on 0860 254 257 within 30 calendar days from date of purchase to arrange courier collection.

DEFECTIVE ITEMS

Should any item that you have purchased online or at any The Body Shop store be the subject of any manufacturing defect or failure, or is unsafe, as contemplated in the Consumer Protection Act, 2008 (“CPA”), it may be returned to a The Body Shop store for replacement, or in exchange for a refund, within six months of the date of purchase, subject to the CPA. The Body Shop and/or its supplier reserve the right to examine the product and test the product to confirm the alleged defect, failure or safety hazard existed at the time of purchase, before the product will be repaired, replaced or refunded.

Complaints and claims must be brought to the attention of Clicks by calling the Customer Service Centre on 0860-254-257 (within South Africa) or +27 21 460-1009 (outside South Africa) (Monday to Friday, 07:00 to 18:00 and Saturdays, 09:00 to 13:00), or emailing [email protected].

AVAILABILITY OF THE SITE

We have taken every care in the preparation of the Site. However, as certain technical matters may be beyond our control, we cannot guarantee that you will have uninterrupted access to the Site at all times.

INFORMATION ON THE SITE

The information on the Site has been included in good faith for general informational purposes only. It should not be relied upon for any specific purpose and no representation or warranty is given as to its accuracy or completeness.

OWNERSHIP OF MATERIALS ON THE SITE

The Body Shop International Plc, unless otherwise stated,is the owner of all copyright and database rights in the Site and its contents. You may not publish, distribute, extract, re-utilise, or reproduce any part of the Site in any material form (including photocopying or storing it in any medium by electronic means) other than in accordance with the limited use licence set out in our copyright notice or as permitted by the Copyright Designs and Patents Act 1988 or the Copyright and Rights in Databases Regulations 1997 as applicable or any equivalent legislation as may apply in your country.

TRADE MARKS

All brand, product and service names used in this Site are the trade marks, trade names or service marks of the Body Shop International Plc unless otherwise stated. You may not distribute products or offer services under or by reference to or otherwise use or reproduce any such trade marks, trade names or service marks without the prior written permission of the Body Shop International Plc or the owner of such trade marks, trade names or service marks. However, The Body Shop International Plc is not legally responsible for the operation, or the content of the Site, the exclusive responsibility for which rests with the Operator.

EXTERNAL LINKS

We may provide links to other websites from time to time. These links are provided for your convenience. We do not endorse or take responsibility for the content of those websites, are not responsible for the availability of these websites and will not be liable in any way for any loss or damage which you may suffer by using those websites. If you decide to access linked websites you do so at your own risk.

DISCLAIMER OF WARRANTIES AND LIABILITY

To the fullest extent permitted by law all warranties (express or implied) in respect of the Site and the content of and your use of the same are excluded.

Except in the case of death or personal injury caused by our negligence, to the fullest extent permitted by law we exclude all liability to you in respect of your use of this Site.

AMENDMENTS OF THE TERMS

We reserve the right to amend these Terms without notice to you from time to time. Any such amendment shall be effective once the revised terms have been posted on the Site.
